Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Gilld ("we," "us," or "our") that governs your use of the Gilld mobile application, the gilld.app website, and any related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

You must be at least 13 years old to create a Gilld account. Users between 13 and 17 may need a parent or guardian's consent under local law. You agree to provide accurate information when registering and to keep your account credentials secure. You are responsible for activity that occurs on your account.

3. Your Content

The Service lets you create, post, and share content — including profile information, chat messages, voice calls, activity-feed posts, comments, reactions, events, and uploaded media (collectively "Your Content"). You retain ownership of Your Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, modify (for the purpose of formatting and delivery), and display Your Content as needed to operate the Service. This license terminates when Your Content is deleted, except to the extent we're required to retain it for legal or audit purposes.

You represent that Your Content does not infringe anyone else's rights and that you have all rights necessary to grant us the license above.

4. Acceptable Use

You agree that you will not:

  • Post content that is illegal, harassing, hateful, threatening, sexually explicit, or that exploits or endangers minors.
  • Impersonate another person, misrepresent your identity, or create accounts to evade enforcement actions.
  • Use the Service to send spam, run automated scripts, scrape data, or place undue load on our infrastructure.
  • Attempt to circumvent block lists, security controls, or rate limits, or attempt to access another user's account.
  • Use the Service to commit fraud or to facilitate any violation of law or third-party rights.
  • Reverse engineer, decompile, or disassemble the Service except as expressly permitted by applicable law.

5. Moderation and Enforcement

Every user-generated content surface in Gilld provides a way to report content and to block other users. Reports are reviewed by our Trust and Safety team within 24 hours. We reserve the right, but not the obligation, to remove content, restrict features, or suspend or terminate accounts that violate these Terms. Repeated or severe violations may result in a permanent ban without notice.

6. Connected Gaming Platforms

Gilld offers optional read-only integrations with Steam, PlayStation Network, and Nintendo. By connecting one of these accounts, you authorize us to read public profile information, your library, achievements, and play activity exposed by that platform's API. We do not place orders, make purchases, or modify any state on your behalf, and we never receive your platform password. You may disconnect any platform at any time. Your use of those platforms remains governed by their respective terms of service, which are not part of this agreement.

7. Voice Calls and Messaging

Voice calls in Gilld are routed through a third-party real-time audio provider (LiveKit). Calls are not recorded by default. Chat messages, voice-call metadata (participants and durations), and uploaded media are stored on our servers as described in our Privacy Policy. We do not read or scan the contents of private messages except when investigating a report or when required by law.

8. Fees and Subscriptions

Gilld is free to use today. We may introduce paid features in the future; if we do, the pricing, billing cadence, renewal behavior, and cancellation policy will be presented to you before purchase. Subscriptions purchased through the Apple App Store or Google Play are managed through those storefronts and are subject to their refund and cancellation policies.

9. Suspension and Termination

You may stop using Gilld at any time and may delete your account in-app under Settings → Account. Account deletion is scheduled with a 30-day grace period; signing back in within that window cancels deletion. After 30 days, your data is permanently removed except where retention is required by law or for safety investigations.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if your activity poses a risk to other users.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILLD AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless Gilld and its affiliates from any claim, demand, or expense (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Service or these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you and Gilld each consent to the personal jurisdiction of those courts. Nothing in this section limits your rights under applicable consumer protection laws.

14. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, post an in-app notice before the new Terms take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
